Terms and Conditions

Effective Date: August 5, 2026   |   Last Updated: August 5, 2026

These Terms and Conditions (“Terms”) govern your access to and use of quitanlephotography.com and your purchase of photographic prints, artwork, licenses, and other products or services offered by Qui Tan Le Photography.

In these Terms, “Qui Tan Le, sole proprietor of Qui Tan Le Photography,” “Qui Tan Le Photography,” “we,” “us,” and “our” refer to the owner and operator of the website. “You” and “your” refer to each website visitor, customer, purchaser, or other user.

By accessing the website, creating an account, submitting an inquiry, or placing an order, you agree to these Terms and our Privacy Policy. Do not use the website or place an order if you do not agree.

1. Eligibility and Authority

You must be legally capable of entering into a binding agreement to make a purchase. If you use the website or place an order on behalf of a company, organization, or another person, you represent that you have authority to bind that party to these Terms.

2. Website Information and Changes

We make reasonable efforts to present accurate information about photographs, products, print materials, sizes, finishes, prices, availability, production times, and shipping. Website content may occasionally contain typographical errors, technical errors, inaccurate descriptions, or outdated information.

We may correct errors, update information, modify products, or discontinue products at any time before an order is accepted. We are not obligated to honor an obvious pricing or product-description error, but if payment has already been collected for an order we cancel, we will issue an appropriate refund.

3. Photographic Prints and Display Variations

The appearance of a photograph on a screen may differ from the finished print. Differences can result from monitor calibration, screen brightness, browser and device settings, printing process, substrate, surface finish, ambient lighting, viewing angle, cropping, and normal manufacturing tolerances.

We may make minor adjustments to cropping, sharpening, output resolution, or color management when reasonably necessary to produce the selected size and material. These adjustments will not intentionally change the essential artistic character of the image.

Frames, mats, room displays, wall mockups, hanging hardware, and decorative accessories shown in product images are illustrative unless the product description specifically states that they are included.

4. Product Availability and Made-to-Order Items

Many photographic prints and finished products are produced individually after an order is placed. Production and delivery times are estimates and may vary depending on product size, material, finishing, laboratory capacity, quality inspection, inventory, carrier conditions, and destination.

An item placed in a shopping cart is not reserved. Limited-edition and other quantity-limited products remain subject to availability until the order is accepted and payment is successfully processed.

5. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. We accept an order when payment is approved and the order enters production or is otherwise confirmed for fulfillment.

We may decline, place on hold, or cancel an order when:

If we cancel an order after payment has been collected, we will refund the amount charged for the canceled portion of the order.

6. Prices, Taxes, Fees, and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Applicable sales tax, shipping, handling, insurance, customs duties, import taxes, and other charges will be displayed or described as required before you complete the purchase. You are responsible for charges imposed by a destination country or local authority unless checkout expressly states otherwise.

Payments are processed through GoDaddy Payments. Depending on the customer’s device and eligibility, Apple Pay or Google Pay may also be available through GoDaddy Payments. We do not directly store complete credit-card numbers or card security codes.

You agree to provide current, complete, and accurate billing, shipping, contact, and payment information. By submitting an order, you authorize the applicable payment provider to charge the total amount shown at checkout.

7. Production, Shipping, and Delivery

Production and shipping estimates are not guaranteed delivery dates unless expressly identified as guaranteed. We will use reasonable efforts to fulfill orders within the stated time.

If we cannot ship within the promised period, we will notify you and offer the delay, cancellation, or refund options required by applicable law. If no shipping period is stated, we will have a reasonable basis to expect shipment within 30 days after receiving a properly completed order. If shipment cannot occur within the applicable period, we will obtain your consent to the delay or issue the required refund.

You are responsible for providing a complete and accurate delivery address. Additional expenses caused by an incorrect address, refusal of delivery, failed delivery attempt, or unclaimed shipment may be charged to you where permitted by law.

Risk of loss and ownership of physical products transfer as provided by applicable law. Delivery scans and carrier records may be used to confirm delivery.

8. Order Changes and Cancellations

Because many products are made to order, cancellation or change requests must be submitted promptly. You may request cancellation within 24 hours after placing an order. A cancellation or change is not guaranteed after printing, framing, finishing, packaging, or other production has begun.

To request a change or cancellation, contact quitanlephoto@gmail.com and include your name and order number. Approved refunds will be issued to the original payment method. Approved refunds will be initiated no later than 30 days after the applicable cancellation or our receipt of returned goods in refundable condition and all information reasonably necessary to process the refund. Your financial institution or payment provider may require additional time to post the credit to your account.

9. Returns and Exchanges

Standard, Non-Custom Products

A standard, non-custom product is eligible for return if you contact us within 14 calendar days after confirmed delivery. The product must be unused, undamaged, unaltered, and returned with all certificates, accessories, and protective packaging reasonably necessary for safe transport.

Unless the product was damaged in transit, defective, or incorrectly supplied, you are responsible for authorized return-shipping costs. Original shipping charges are not refundable except where required by law or expressly approved by us.

Custom and Made-to-Order Products

Custom-sized prints, personalized products, specially commissioned works, signed or numbered editions, framed-to-order products, and other products made specifically for an order are final sale once production has begun, except when the product arrives damaged, defective, or materially different from the accepted order.

Return Authorization and Inspection

Contact us before returning a product. Unauthorized returns may be refused or delayed. A return is not complete until the product is received and inspected. Subject to applicable law, we may reduce or deny a refund when a product has been damaged after delivery, improperly handled, installed, altered, or returned incomplete.

10. Damaged, Defective, or Incorrect Orders

Inspect your order promptly after delivery. Report visible shipping damage, a manufacturing defect, or an incorrect product within 7 calendar days after delivery by contacting quitanlephoto@gmail.com.

The seven-day reporting period helps us investigate carrier and production claims and does not limit any rights or remedies that cannot be waived under applicable law.

Please provide your order number, a description of the problem, photographs of the product, and photographs of the packaging and shipping label when shipping damage is involved. Keep the product and all packaging until the claim is resolved because the carrier or production provider may require inspection.

When a claim is approved, we may provide a replacement, repair, store credit, or refund, depending on the circumstances and applicable law. Normal screen-to-print color variation, minor material variation, or a difference resulting from a customer-selected crop is not a defect.

11. Limited-Edition Prints

When a product is identified as a limited edition, the product page or accompanying documentation will describe the edition size, numbering method, signature, artist proofs, and certificate details, when applicable.

Purchasing a limited-edition print transfers ownership of that physical copy only. It does not transfer copyright, reproduction rights, commercial-use rights, digital rights, or ownership of the underlying photograph.

A damaged limited-edition print may need to be returned or verifiably destroyed before a replacement bearing the same edition number is issued.

12. Copyright and Intellectual Property

Unless otherwise stated, all photographs, galleries, videos, graphics, logos, text, designs, page layouts, and other website content are owned by or licensed to Qui Tan Le Photography and are protected by copyright, trademark, and other intellectual-property laws.

No website content or purchased print may be reproduced, copied, scanned, photographed for reproduction, distributed, published, publicly displayed for commercial purposes, altered, resold as another product, sublicensed, or used to create derivative works without prior written permission.

Purchasing a physical print does not grant permission to:

We grant you a limited, revocable, nonexclusive license to view publicly available website content for personal, noncommercial purposes only.

13. Photography Licensing

Commercial, editorial, advertising, publishing, hospitality, interior-design, corporate, and other professional uses require a separate written license. No license is granted merely by viewing the website, downloading a preview, sharing a website link, or purchasing a decorative print.

Send licensing inquiries through the website Contact page or to quitanlephoto@gmail.com. A license is effective only when its scope, fee, term, territory, media, and other conditions have been agreed in writing.

14. User Submissions, Reviews, and Testimonials

When you submit a review, testimonial, comment, photograph, or other content for public display, you represent that you created it or have permission to submit it, that it is accurate to the best of your knowledge, and that it does not violate law or another person’s rights.

You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, format, display, and publish public reviews, testimonials, and related submitted content for website operation, customer service, and promotion of our business. This license does not give us ownership of private materials submitted solely for customer service, licensing, or a commission inquiry.

We may remove or decline content that is unlawful, threatening, defamatory, fraudulent, obscene, misleading, infringing, abusive, spam, unauthorized advertising, or technically harmful.

15. Prohibited Conduct

You may not:

16. Customer Accounts and Security

If customer accounts are enabled, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Notify us promptly if you believe an account, password, or payment method has been compromised.

We may suspend or terminate an account that appears compromised, fraudulent, abusive, inactive for an extended period, or in violation of these Terms.

17. Third-Party Services and Links

The website may use or link to services operated by payment providers, shipping carriers, print laboratories, social-media companies, map providers, video platforms, analytics providers, and other third parties.

We do not control and are not responsible for third-party websites, content, availability, privacy practices, security, products, or terms. Your use of a third-party service is subject to that provider’s policies and terms.

18. Website Availability and Maintenance

We may modify, suspend, restrict, or discontinue all or part of the website for maintenance, security, technical, business, or legal reasons. We do not guarantee uninterrupted access, preservation of every feature, or compatibility with every browser or device.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis. We do not guarantee that the website will always be available, uninterrupted, secure, error-free, or free of harmful components, or that every error will be corrected immediately.

We do not guarantee that colors displayed on a device will exactly match a finished print or that third-party services will remain available. Nothing in these Terms excludes warranties, guarantees, remedies, or consumer rights that cannot lawfully be excluded or limited.

20. Limitation of Liability

To the fullest extent permitted by law, Qui Tan Le Photography and its owner, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website, its content, a product, an order, or these Terms, including loss of profits, business, data, or goodwill.

To the fullest extent permitted by law, our total liability concerning a product, service, or order will not exceed the amount you paid for the product, service, or order giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited, including rights and remedies available under applicable consumer-protection law.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Qui Tan Le Photography and its owner, employees, contractors, and service providers from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, fraudulent conduct, or public content you submit.

This section does not apply to the extent a claim was caused by our own negligence, willful misconduct, or other conduct for which liability cannot lawfully be excluded.

22. Events Beyond Reasonable Control

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, wildfire, power or internet interruption, labor disruption, carrier delay, supply shortage, production-laboratory failure, government action, civil emergency, public-health emergency, war, or cyberattack. This section does not eliminate any refund or cancellation right required by applicable law.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except when mandatory consumer law in your location provides otherwise.

Before filing a legal action, you agree to contact us and make a good-faith effort to resolve the dispute informally. Unless applicable law requires otherwise, disputes arising from these Terms, the website, or a purchase will be brought in a court of competent jurisdiction in California.

Nothing in this section prevents either party from seeking appropriate relief for copyright infringement, unauthorized image use, security violations, misuse of intellectual property, or another claim requiring immediate relief.

24. Changes to These Terms

We may revise these Terms to reflect changes to the website, products, services, business practices, or applicable law. Updated Terms will be posted on this page with a revised “Last Updated” date and will apply prospectively unless applicable law requires otherwise.

Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms. Material changes affecting an existing order will not be applied retroactively without a lawful basis or your agreement.

25. Severability, No Waiver, and Assignment

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it enforceable.

Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a lawful sale, merger, reorganization, or transfer of the business.

26. Entire Agreement

These Terms, the Privacy Policy, product-page information, checkout disclosures, and any additional written policies presented during a transaction constitute the agreement between you and Qui Tan Le Photography concerning website use and purchases.

A separately signed photography license, commission agreement, wholesale agreement, or other written contract controls to the extent it directly conflicts with these general Terms.
